By accessing or using INeverLeft's website or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Services
INeverLeft provides professional memorial research and creation services. Our services include historical research on behalf of families, creation of digital memorial pages, grief liaison support, and related services. We are currently developing AI-powered features as a beta offering.
Eligibility
You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old and have the legal authority to enter into this agreement.
Your Responsibilities
When using our services, you agree to:
- Provide accurate and complete information when requested
- Have the legal authority to authorize research and memorial creation for the deceased individual you name
- Use our services only for lawful purposes
- Not misrepresent your identity or your relationship to the deceased
- Respect the privacy and dignity of the deceased and their family members
Payment and Refunds
Service fees are disclosed prior to engagement. Payment is due as agreed at the time of service initiation. Due to the nature of our research services — which begin immediately upon engagement — refunds are evaluated on a case-by-case basis. Intellectual Property
Memorial pages created by INeverLeft using your family's provided materials remain the property of your family. Historical documents and records we locate through research are in the public domain. The INeverLeft platform, design, and underlying technology remain the intellectual property of INeverLeft.
Third-Party Research Sources
Our research draws from publicly available records, databases, archives, and third-party services. We make reasonable efforts to ensure accuracy but cannot guarantee the completeness or accuracy of historical records obtained from third-party sources.
AI Beta Features
AI-powered features are offered in beta form. Beta features are provided "as-is" and may be modified, suspended, or discontinued at any time. By participating in the beta program, you acknowledge that the technology is evolving and may not perform perfectly. You retain full control over your data and may withdraw from the beta program at any time.
Limitation of Liability
INeverLeft's liability to you for any cause whatsoever shall be limited to the amount you paid us for the services giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
Disclaimer of Warranties
Our services are provided "as is." We make no warranty that our services will be uninterrupted or error-free, or that research will locate any specific records or documents. We do warrant that we will perform our services with reasonable professional care and skill.
Termination
Either party may terminate the service relationship at any time. Upon termination, your memorial content will remain accessible for 30 days, during which you may export your data. After 30 days, your data may be permanently deleted unless you arrange otherwise in writing.
Governing Law
These Terms are governed by the laws of the State of Arizona. Any disputes arising under these Terms shall be resolved in the courts of Arizona.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
